David Shelby is the founding partner of Shelby Roden LLC in Birmingham, Alabama. He received his undergraduate degree from Auburn University and returned to Birmingham to attend law school at the Cumberland School of Law at Samford University, where he received his J.D. and MBA in 1979. In the beginning, his practice focused on labor-management relations and evolved over time to focus on environmental and complex litigation.

Photo of Robert B. Roden Robert B. Roden is the senior managing partner of Shelby Roden LLC. Mr. Roden is a litigator with over 35 years of experience in cases involving toxic exposure, class actions, products liability and personal injury/death. For the past decade, his practice has focused on chemical/toxic exposure cases and defective products litigation. He has tried more than one hundred cases to verdict and settled hundreds more.

Mr. Roden currently serves on the BP Oil Spill Plaintiff’s Economic Damages Committee and has previously served on Litigation Steering Committees and acted as lead counsel in a number of complex mass tort, products liability and class action cases. He has extensive experience in litigating mass toxic exposure cases that have resulted in property damage, personal injuries and economic losses. Some of those cases include:

  • The Tolbert PCB litigation in Anniston, Alabama settled for over $350 million. The case involved decades of pollution by Monsanto Chemical in the communities and waterways of Anniston, Alabama.
  • Class counsel in a multi-million dollar class action against McWane Cast Iron Pipe Company concerning its pollution of the Village Creek watershed and adjacent properties in Birmingham, Alabama.
  • Member of the Plaintiff’s Coordinating Committee for MDL-1598, a multi-defendant MDL against ephedra manufacturers asserting claims for personal injuries and wrongful death caused by their products.

Beyond Mr. Roden’s legal work, he has also been active in charitable endeavors. In 1992, Mr. Roden played a key role in establishing the Alabama Civil Justice Foundation (ACJF), which serves as a source of grant funds to charitable organizations throughout Alabama. Working through the Alabama Trial Lawyers Association, he created the Foundation as a vehicle for the community to assist Alabama families and citizens in need. Grants awarded by the Foundation are funded from IOLTA (interest on lawyers’ trust accounts). Mr. Roden is Chairman Emeritus and an active member of the Foundation board.

Mr. Roden, along with three other law firms, established a one million dollar fund at ACJF to improve the educational opportunities for the children living in the Anniston area impacted by PCBs. Also, as one of the lead counsel in the PCB litigation Mr. Roden was instrumental in establishing the West Anniston Medical Clinic in Anniston for the purpose of addressing the health of the residents in the area. He has served on the West Anniston Medical Clinic Board since its inception in 2005. The Clinic now serves thousands of residents of Anniston providing medical services for them.

Mr. Roden established the Village Creek Greenway Fund, a one million dollar fund on behalf of the Freshwater Land Trust, for the support charitable and educational purposes of environmental, flood migration and recreation projects along Village Creek. The fund promotes projects that further the development of the Village Creek Linear Park and improve water quality along Village Creek.

Photo of Jodi K. McKelvin Jodi K. McKelvin, a native of Panama City, Florida, attended law school at the Cumberland School of Law at Samford University and started her legal career with Straus & Boies, LLP in Birmingham. Her work there focused on antitrust and class action litigation. She joined Shelby Roden, LLC in 2002, where she has focused on the litigation of plaintiffs' personal injury, wrongful death and toxic exposure cases. Shelby Roden LLC attorneys were heavily involved in multi-district litigation over injuries and deaths caused by dietary supplement products that contained ephedra, as well as toxic exposure cases against Monsanto Chemical Company for injuries caused by its pollution of the Anniston, Alabama area with polychlorinated biphenyls.

In addition to litigation, she has devoted a significant part of her practice to a developing field: Elder Law. Elder Law involves multiple areas of the law that affect adults as they age, including the need for estate planning, probate and long term care planning. She is a former Chair of the Elder Law section of the Alabama State Bar and is a member of the Elder Law Services Committee of the Birmingham Bar Association.

She lives in Vestavia with her husband, Michael, and two children.

Photo of M. Shane Lucado Shane Lucado practices predominantly in Atlanta and Birmingham handling complex litigation, commercial and business litigation, and personal injury. He began work for clients harmed by the BP Oil Spill within weeks following the oil spill. By May 11, 2010, the Wall Street Journal reported on Shane’s early efforts to oppose BP’s attempt to transfer all the oil spill cases to Houston, Texas, where BP had considerable influence. On June 28, 2010, the Wall Street Journal took interest in Shane’s case filed against BP and others for alleged unfair practices in its claims processes. Shane was also one of only fifteen lawyers nationally, and only one of two Alabama lawyers, who argued before the federal panel responsible for coordinating the hundreds of cases filed against BP. The Panel eventually transferred all the federally filed cases to Judge Barbier in New Orleans.

Since the beginning, Shane has worked with our firm in pursuing and managing hundreds claims against BP, the GCCF and the current Claims Administrator for damages caused by the BP Oil Spill.

Photo of Don Freeman Don Freeman, a native of Alabama, attended law school at the Cumberland School of Law at Samford University. He received his undergraduate degree from Birmingham-Southern College, where he studied Business Administration and Political Science. Mr. Freeman has worked at Regions Financial, as well as in the bankruptcy, corporate, and estate planning areas of the law. At Shelby Roden he currently focuses primarily on multi-district litigation.
