Johnson & Johnson has been ordered to pay roughly $100 Million to settle more than 1,000 lawsuits. However, J&J stands by their position, noting that this settlement is agreed to “without an admission of liability and in no way changes our position regarding the safety of our products,” according to a J&J spokesperson. Despite their position of safety, in May 2020, the company announced they would discontinue all talc-based baby powders and this first bulk settlement could mean that J&J “is trying to get ahead of” the tens of the other ongoing lawsuits, Bloomberg reported. J&J is facing more than 20,000 parallel lawsuits, alleging claims related to ovarian cancer and mesothelioma. Bloomberg Intelligence estimated in July that settling all the outstanding cases could cost J&J as much as $10 billion.
J&J will face their next Talc lawsuit, where Plaintiff Rosalino Reyes III alleges that he used their Talc powder for almost 50 years before being diagnosed with mesothelioma in 2019. Oral arguments for this case are set to begin on October 13, 2020, in California. The ongoing lawsuits regarding Talc powder have been going on for four years, Forbes reported; however, even in the face of delays caused by the COVID-19 pandemic, these suits are moving forward.
