$5.5 Billion Settlement reached for Talc Claims

NORTH BRUNSWICK, NJ– On July 27, 2026, Johnson & Johnson announced a proposed $5.5 billion resolution of approximately 76,000 remaining lawsuits alleging that its talc-based products, including Johnson’s Baby Powder, caused ovarian cancer. The agreement covers claims pending in the federal multidistrict litigation in New Jersey and related state courts, representing nearly all outstanding talc cases against the company.

The proposal follows more than 15 years of litigation, mixed trial outcomes, and three unsuccessful attempts by J&J subsidiaries to resolve the claims through bankruptcy. Under the terms, Johnson & Johnson commits a minimum of $5.5 billion to victims, with an initial capped payment of $3 billion due in 2027. The settlement assigns values to qualifying claims and is structured to deliver compensation more quickly than earlier bankruptcy plans. The total amount could ultimately exceed $5.5 billion depending on the number of participating claims and their individual valuations. It is conditioned on participation by lead plaintiff firms representing at least 95% of the remaining ovarian cancer claims. Mesothelioma claims have largely already been resolved through prior settlements.

If finalized, the settlement would primarily address existing filed ovarian cancer claims. It does not cover future claims or separate litigation pending in the United Kingdom. Individuals who used Johnson’s Baby Powder or similar talc products for feminine hygiene and later developed ovarian, fallopian tube, or primary peritoneal cancer—or the families of those who have passed away—may be affected, subject to individual case facts, medical documentation, and applicable statutes of limitations.

The proposal requires the 95% participation threshold to be met and is expected to involve further court oversight in the MDL before becoming final. Once approved, a claims process would follow to evaluate and value individual cases.
