BIRMINGHAM, Ala. – On October 01, 2020, Judge Proctor issued the Seventh Amended Scheduling Order (Exclusive to Provider Track). The next upcoming deadline is for the Provider Plaintiffs’ Renewed Motion for Class Certification, along with Defendants’ Opposition to Providers’ Class Certification Brief, which are each due on October 9, 2020. Just as in Provider Plaintiffs’ original Motion for Class Certification filed in April 2019, Provider Plaintiffs’ will once again seek Class Certification for Acute and Non-Acute Care Hospital Providers.
After the Renewed Motion is filed, Defendants’ class certification experts will be deposed between October 23, 2020 and November 13, 2020. Then, Providers’ Daubert motions to exclude Defendants’ class certification experts and Providers’ Responses to Defendants’ Daubert motions to exclude Providers’ class certification experts are due on November 23, 2020. Before the end of the year, the Providers’ Class Certification Reply Brief and Providers’ class certification expert rebuttal are due on December 2, 2020, which is also the deadline for Defendants to produce Damages and Merits Expert Reports and Discovery. The schedule picks back up in January, 2021, and goes through April 1, 2021.
