The Camp Lejeune water contamination litigation has reached an important milestone. The first bellwether trial concluded on October 28, 2026, while efforts continue to develop a broader framework for resolving pending claims.
First Bellwether Trial Completed
The case involved former Marine Frank Mousser, who alleges that exposure to contaminated water at Camp Lejeune caused his kidney cancer. Judge Terrence W. Boyle heard approximately three days of testimony and evidence. According to the Plaintiffs’ Leadership Group’s October 30 update, the judge will issue a decision after reviewing the evidence; no date for that ruling has been announced. The next kidney cancer bellwether trial, involving David Fancher, is scheduled to begin November 9.
Bellwether trials allow the parties to test evidence and legal arguments in individual cases. Although these decisions do not determine the outcome of every claim, they may help guide future litigation and settlement discussions.
Court Recognizes Progress in Settlement Efforts
In its September 29 order, the Court found that progress toward a global settlement was being made, while emphasizing that additional work remained. The Court directed counsel for the plaintiffs and the Department of Justice to continue weekly meetings with the Settlement Masters. It also reappointed the Plaintiffs’ Leadership Group through October 30, 2027, citing the importance of continuity in the ongoing negotiations.
The Court asked the parties to use their best efforts to achieve a global settlement by October 30. That date has passed without a publicly confirmed agreement. The eligibility requirements, compensation amounts, and payment schedule for any broader resolution remain uncertain.
Some qualifying claims have already been resolved through existing settlement procedures. The Department of Justice reports that, as of September 18, 2026, Camp Lejeune settlement offers exceeded $1.1 billion and payments exceeded $879 million. Those individual settlements do not establish a global resolution for all pending claims.
What This Means for Our Clients
We understand that the continued wait is difficult for claimants and their families. The completed trial and the Court’s recognition of settlement progress are encouraging developments, but they do not establish when any particular claim will be resolved or what compensation may be available.
Shelby Roden continues to monitor the litigation and settlement efforts. We will contact our clients as material developments occur or if additional information is needed to advance their claims.
