Talc Litigation Update: Where the Proposed $5.5 Billion Settlement Stands

Following the proposed $5.5 billion resolution announced in July, people pursuing ovarian cancer claims against Johnson & Johnson continue to await the next steps in the settlement process. The proposal represents a significant development, but it remains subject to participation requirements and other conditions.

Where the Settlement Stands

In its latest quarterly filing, Johnson & Johnson continued to describe the proposed agreement as conditioned on participation by at least 95% of the remaining claims, among other requirements. The proposal addresses ovarian cancer litigation pending in the federal multidistrict litigation in New Jersey and related state court proceedings.

The announcement of a settlement framework does not mean that every claimant has received an offer or that an individual claim’s value has been determined. Claimants should review any proposed terms with their attorneys before deciding how to proceed.

What the Payment Schedule Means

Johnson & Johnson’s announcement calls for an initial payment of no more than $3 billion in 2027, with no additional payments due before 2028. Those dates concern the company’s funding obligations under the proposal; they do not establish when any particular claimant will receive compensation.

Individual payment timing will depend on the settlement’s implementation and the requirements applicable to each claim. We cannot yet provide a confirmed payment date for any particular client.

Mesothelioma Claims Remain Separate

The proposed ovarian cancer agreement does not resolve the ongoing mesothelioma docket. Johnson & Johnson confirmed that distinction in its latest quarterly filing. Clients with mesothelioma claims should not assume that announcements about the ovarian cancer proposal apply to their cases.
