May 1, 2024— After two failed attempts for bankruptcy protection, Johnson & Johnson has announced it is yet again preparing for a third attempt. J&J announced their plan to resolve up to 100,000 ovarian cancer claims through bankruptcy with a $6.48 billion proposed settlement fund. Prior to filing the plan with the bankruptcy court, J&J will hold a three-month voting period for victims to vote on the proposed settlement terms and amounts. If 75% of claimants vote in favor of the proposed bankruptcy plan, J&J will proceed with their third bankruptcy filing.
The proposed bankruptcy settlement does not include claims alleging mesothelioma, nor any claims brought by state attorney generals, as these will remain in traditional litigation. In the meantime, the ovarian cancer litigation against J&J continues to move forward with discovery proceedings in preparation for MDL Bellwether Trials.
