Blue Cross Blue Shield Settlement Faces Delays

The Subscriber Class in the Blue Cross Blue Shield litigation received final approval of the $2.67 settlement against the Blues on August 9, 2020; however, disbursements have been delayed as this settlement faces multiple objections. Several class members have filed appeals challenging the final approval of the settlement and fees. Home Depot, one of the objectors, stated their concern that this settlement will bar them from bringing future antitrust claims against the Blues.

It is unclear how long the appeal process will take, but no payments will be made from the Subscriber settlement until all appeals are resolved. There is a Status Conference on February 13, 2023 in Birmingham.
