Final Approval Granted for $2.67 Billion Antitrust Settlement Against BCBS

On August 9, 2022, U.S. District Judge R. David Proctor in the Northern District of Alabama issued an order granting final approval of the $2.67 billion Blue Cross Blue Shield antitrust settlement for the Subscriber Plaintiffs. This is the final approval of the settlement agreement for Subscriber Plaintiffs that was reached in October 2020. The settlement award will be distributed to plaintiffs according to the terms of the agreement. This settlement not only provides monetary relief but will also help create an evenhanded market for health insurance by requiring increased competition between the Blues insurers. In the order granting relief for the Subscriber Plaintiffs, Judge Proctor stated that this settlement “provides historic, transformative, procompetitive injunctive and equitable relief.”
